Breyers Ice Cream paid nearly $9 million as part of a class action lawsuit settlement, and you may be entitled to some of that money.
On September 13, the Bronx County Supreme Court in New York announced a settlement against Conopco and Unilever United States. Conopco and Unilever are Breyers’ advertisers and parent companies, respectively.
The class action lawsuit concerns Briar’s Natural Vanilla Ice Cream flavor, which the company claims falsely advertised as having real vanilla flavor.
“Plaintiffs allege that Defendants’ labeling of Briar’s Natural Vanilla Ice Cream does not mislead consumers into believing that the ice cream contains vanilla flavor derived solely from the vanilla plant and not from non-vanilla plant sources. “This action was filed against the defendants, alleging that it did not contain any botanicals other than vanilla – vanilla flavoring from the vanilla plant,” the court explained in a release.

“Defendants dispute all of these allegations and deny any wrongdoing. The court has not yet decided who is correct.”
Consumers who purchase natural vanilla flavored ice cream between April 21, 2016 and August 14, 2024 may be entitled to a cash refund.

Although the jury is still out on the authenticity of the vanilla flavor, the defendants have agreed to create an $8.85 settlement fund for customers who paid for cartons of natural vanilla.

The court will award consumers $1 for each carton of Briar’s Natural Vanilla Ice Cream flavor they purchase.

To qualify, consumers are required to provide proof of purchase. Customers with valid receipts have the right to submit any number of claims as long as they can authenticate them.
The court allows Briers customers without proof of purchase to submit up to eight claim forms, with a total payout of up to $8 per person.

The court also found that within one year of the settlement, Bryers “will be required to develop a new product formulation that does not contain vanilla derived from non-vanilla plant sources.”
